Kasana Health Terms & Conditions.
Welcome to the kasanahealth.com and kasanahealth.org websites (the "Site"). Kasana Health provides products and services to you (hereinafter, the "Services") that are subject to the notices, terms, and conditions set forth in this agreement. Our Services may include, without limitation, tools, applications, email services, chat areas, communities, video content, calendars, and downloadable mobile applications related to the Site or provided through the Site. When you use any of our Services, you will be subject to the rules, guidelines, policies, terms, and conditions applicable to such service as described in this Agreement. We reserve the right to change these terms and conditions at any time. 

 

Accessing, browsing, or otherwise using the Site or its Services indicates your agreement to all the terms and conditions in this Agreement. If you do not agree to be bound by these Terms and Conditions, you may not access or use the Site or Services.

Participation Requirements.

You must be at least 18 years of age (or under the supervision of a parent or guardian) to use our Site and Services.

You will use the Kasana Health Services at your own risk. If you have any known pre-existing illnesses, suffer from any cardiovascular conditions, spinal and/or joint problems, or other health conditions that limit your athletic performance, please first consult a physician before you begin to use Kasana Health's services.

 

Collection of Fees.

Fees for a subscription are collected in advance at the beginning of every month (30 days period) starting the day the subscription agreement is concluded. The subscription will be automatically renewed for the duration of the contract and the fee will be collected in advance at the beginning of the applicable billing period.

 

Fees for a one-time purchase are collected at the time of purchase.

 

Payment Methods.

You can book and pay for Kasana Health services on our website kasanahealth.com. Currently accepted payment methods are: PayPal, Mastercard, Visa and American Express. If payment is declined for reasons for which you are responsible (e.g., because the amount paid is not covered by funds in your account or because the limit of your credit card has been exceeded), we have the right to charge you for any costs and/or expenses actually incurred by us as a result.

 

We reserve the right not to offer certain payment methods and to refer you to other payment methods if there is a valid reason for doing so.

 

Payment Default.

We reserve the right to pursue additional remedies that may be available to us as a result of your payment default.

 

Termination of Paid Subscription

You may cancel your subscription at any time for any reason and thereby also terminate your user agreement in its entirety. If at the time you cancel your account you still have a valid subscription, any amount you may already have paid for the subscription will not be refunded – either in whole or in part.

 

If you decide to cancel your subscription to Kasana Health's services, you must send us an e-mail at hello@Kasanahealth.com, so that we can erase your user data. Please note that after your user account has been canceled all content and workout data will or may be erased by us.

 

Termination for Good Cause.

Irrespective of the foregoing provisions, either party has the right to terminate contracts for good cause. Specifically, we have the right to terminate the user agreement or your subscription with immediate effect and to cancel your user account if you have seriously or repeatedly breached provisions of the user agreement and/or these General Terms and Conditions or if you are behind with payment despite repeated attempts to collect said payment(s).

 

Intellectual Property

All text, photographs, videos, graphics, images, audio clips, and software belong exclusively to Kasana Health and are protected by international copyright laws.

 

You may not reproduce, distribute, display, sell, lease, transmit, create derivative works from, translate, modify, reverse-engineer, disassemble, decompile or otherwise exploit this Site or any portion of it unless expressly permitted by us in writing.

 

Liability Waiver.

By using our website or subscribing to our services you consent to the terms of our Liability Waiver.

International Access.

This Site may be accessed from all countries. If you access and use this Site from outside of North America, you are responsible for complying with your local laws and regulations.


The Kasana Health services can be used anywhere and anytime via our website, phone app and / or other digital platforms owned / managed by Kasana Health. There are no geographical limitations for our customers unless so imposed by your local government.

This Site may contain links to other sites on the Internet that are owned and operated by third parties. You acknowledge that we are not responsible for the operation of or content located on or through any such site.

 

Changes to General Terms and Conditions.

We reserve the right to make changes to these General Terms and Conditions. If and when We make changes to the General Terms and Conditions, you will be notified of any changes to our General Terms and Conditions by email or through a notification on our Site. If you continue to use our Kasana Health services without objection, you will be considered to have accepted the new General Terms and Conditions.

2. Liability Waiver.

 

Disclaimer

You should always consult with a medical doctor and / or other health care professional before beginning this or any other health & wellness plan to ensure that it is suitable to your specific needs.

 

This is particularly true if you (or a family member) have one or more of the following, but not limited to; a history of high blood pressure or heart disease, have ever experienced chest pain when exercising or have experienced chest pain in the past month when not engaged in physical activity, smoke, have high cholesterol, have diabetes, are obese, have a bone or joint problem that could be made worse by a change in physical activity and / or have cancer or another autoimmune illness. Do not start this wellness program if your physician or health care provider advises against it. If you experience faintness, dizziness, pain or shortness of breath at any time while exercising you should stop immediately and seek medical assistance.

 

Kasana Health is a provider of health & wellness information, including but not limited to, fitness regimes, nutritional information and general lifestyle practice recommendations, and the information / guidance provided is for educational purposes only. Kasana Health is not a substitute for medical treatment, advice and / or diagnosis.  If you have any concerns or questions about your health, you should always consult with a physician or other health-care professional. Do not disregard, avoid or delay obtaining medical or health related advice from your health-care professional because of something you may have read on this site and / or discussed with your Kasana Health coach. The use of any information provided on this site and via other Kasana Health methods of communication is solely at your own risk.

Acknowledgement and Assumption of Risks.

I hereby understand and acknowledge that the training, programs and events held by Kasana Health may expose me to many inherent minor or severe risks, including accidents, injuries or illnesses. 

I assume all risks associated with participation including, but not limited to, falls, contact with other participants, the effects of the weather, including high heat and/or humidity, and all other such risks being known and appreciated by me.

 

Video, Photo and Media Authorization

I understand that Kasana Health produces promotional material related to its programs, events and activities. By participating in their events, activities and programs, I give permission to Kasana Health, and/or parties designated by Kasana Health, to photograph/video me and use such photographs and videos in all forms of media.

I understand and agree that I will not receive any payment or any royalty for the publication of the photographs/videos, and I hereby release Kasana Health and/or any parties designated by Kasana Health from any such claims.

 

Waiver of Liability

After having read this waiver and knowing these facts, and in consideration of acceptance of my participation and Kasana Health furnishing services to me, I agree, for myself and anyone entitled to act on my behalf, to HOLD HARMLESS, WAIVE AND RELEASE Kasana Health, its officers, agents, employees, organizers, representatives, and successors from any responsibility, liabilities, demands, or claims of any kind arising out of my participation in, but not limited to, Kasana Health trainings, programs and/or events.

3. Privacy Policy.

 

Confidentiality.

Kasana Health employs a strict confidentiality policy and we agree to keep all conversations and information with the Client private and confidential. No personal ideas, information or thoughts shared with a Kasana Health team member will be shared outside of the Kasana Health team and only then in the context of determining how to best assist the Client in achieving their goals.

 

What personal information do we collect from the people that visit our website?

When you sign up to book an initial call on our site and / or place an order via our website, you will be asked to enter your name, email address, phone number and credit card information. Additional information (general health, fitness, lifestyle habits, or other details) will be asked during the initial phone call and follow-up questionnaire to better help you with your experience.

 

How do we use your information?

Our goal in collecting personal information from you is to provide an efficient, meaningful, and customized experience. For example, we may use the information we collect from you in the following ways:

  • To allow us to create and deliver the most relevant and beneficial content for you.

  • To follow up with you and support you during your program.

  • To communicate with you on customer service inquiries or any other requests that you may have.

  • To quickly process your transactions.

 

How do we protect your information? 

Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential. In addition, all sensitive/credit card information you supply is encrypted via Secure Socket Layer (SSL) technology.

 

All payment transactions are processed through a gateway provider and are not stored or processed on our servers.

 

Distribution of Information.

We do NOT sell, rent, trade, license or otherwise disclose ANY of your personal information or financial information to anyone except in the event of fraud prevention or investigation (as permitted or required by law).
